ICC issues first appeal judgment on reparations in the Lubanga case

Today, the Appeals Chamber of the International Criminal Court (ICC) issued its first judgment on reparations for victims in the case of Thomas Lubanga Dyilo (Lubanga). The Appeals Chamber held that the Trial Chamber committed a number of errors in its decision of August 2012, which established the principles and procedures to be applied to reparations in the case, and amended the decision accordingly. Significantly, the Appeals Chamber rejected the Trial Chamber’s holding that reparation awards should be formulated and implemented to include victims of sexual and gender-based violence.
